5.  ਫੈਸਲਾ This case, again, came up for hearing before the Committee on 22.02.2017. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Mulkh Raj Saini an employee of the consumer appeared in the meeting. Dy CE/Op Circle Jalandhar vide his Memo No. 2469/71 dated 21.02.17, presented analysis report of ASE/EA&MMTS-2 Jalandhar (bearing memo No.24 dated 20.2.2017) , reproduced as under : ` “The subject cited connection was checked by the undersigned on dated 25.1.2016 vide ECR No. 18/112. During study of print- out it was observed that meter had stopped recording energy from 12.1.2016 at 1208 hrs. to 25.1.2016 at 1702 hrs. Thus meter didn’t record any energy for 13 days 4 hours and 54 minutes. The Kwh reading during this period remained static at 5960344.00. In addition to this it was also observed that one phase CT was in make/break mode and thus this discrepancy in the meter also effected on its consumption. Means recorded less consumption. Last projection of this discrepancy in the tamper data was on dated 21.12.15, means it was going on before this projected date. Again DDL/Testing of the metering equipment was done on dated 15.2.16 vide ECR No.32/113 as referred by Addl.SE/MT Jalandhar and during checking it was observed that on meter display current was 6.67,0,5.73A, but on MTC it was 0.60,0.45,0.51A, so the meter declared defective. Under these prevailing conditions accuracy of the meter was recommended to be done in ME lab, Jalandhar to find out the effect of different load conditions on the meter. The test results obtained on 12.5.16 of ME lab, projected a slowness factor of minus 33%. Thus instructed to overhaul the account of the consumer on two accounts first from 12.1.16 to 25.1.16 when meter remained in OFF mode and did not record any energy and the second one is of make /break of one no. CT, these symptoms of make/break of CT also projected in the cumulative tamper data having status of current failure on R-phase CT, 22 days, Y-phase CT 88 days and B-phase CT 166 days. It clearly states that meter was not recording proper energy due to unbalanced CT when the load on all the three phases became low and unbalanced status became failure when the value of current drops from the threshold value. The exact date when these two discrepancies crept in the meter cannot be specified due to non-availability of data before 21.12.15. But it is clear that meter recording had got defective before 21.12.15, the last projection in the tamper data. The DDL/Checking of the new meter was done on dated 24.1.17 vide ECR No.39/183. Parameters of voltage/current at site were in order and balanced. From the print -out from 13.11.16 to 24.1.17, voltage/current on all the three phases were in order and balanced”. The committee was convinced with the findings of ASE/EA&MMTS-2 Jalandhar, which are based on data as per DDL print- out and ME Lab report(where the meter was observed to be slow by 33% when checked at different loading conditions). The committee also observed that disputed meter of the consumer did not record any energy from 12.1.2016 to 25.1.2016 and reading remained static at 5960344 Kwh. However, the committee did not consider it appropriate to increase the amount already charged (disputed amount of Rs.983929) by overhauling the account from 3.9.2015 to 11.4.2016 (uptodate of replacement of defective meter) with slowness factor of 33% as per report of ME Lab. The major submission of the representative of the consumer was that consumption of the petitioner did not decrease during the disputed period, when compared with consumption of previous period, as such overhauling of account with 33% slowness factor is not warranted. However, the committee kept in view the report submitted by ASE/OP Model Town Jalandhar bearing memo No.1364 dtd. 21.2.2017 (addressed to Dy.CE/OP Circle, Jalandhar) wherein it has been made clear that there are no. of tenants using supply from the connection. As such, the total consumption is not required to be compared with the consumption of previous year to arrive at any conclusion. The representative of consumer could not explain the exact number of tenants using supply but confirmed that the connection has been released in Shakti Mall (Shopping Complex) where large no. of showroom/shops are using supply and the no. of such shops/showrooms keep on changing from time to time. The case was deliberated at length and the committee was of the unanimous view that current failures on phases at different time intervals is evident from DDL print-out and 33% slowness of the meter is very much clear from the ME lab report. Therefore, ZDSC decided that the amount charged to the consumer for the period 9/2015 to 4/2016, with 33% slowness factor is correct and recoverable.The balance amount be recovered from the consumer alongwith applicable surcharge/interest as per instructions of PSPCL.

1 Wed 14, Sep 2016  This case came up for hearing before the Committee on 14-09-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Mulkh Raj Saini an employee of the consumer has appeared and submitted an application signed by Mr. Vikas Kapoor Director ISHVI Enterprises Private Limited Jalandhar dated 14-09-16 wherein he has submitted for adjournment the same has been placed on record. The consumer is directed to submit his representation within 7 days from today to the Dy. CE/DS Circle, Jalandhar who will give his comments on it within next 7 days with copy to the consumer. Sh. Mulkh Raj has undertaken that he will inform the consumer accordingly in this case. It has also been made clear to the Sh. Mulkh Raj to convey to the consumer that this is the final opportunity and no more adjournment shall be granted under any under circumstances. The case is adjourned accordingly.
2 Thu 20, Oct 2016  This case, again, came up for hearing before the Committee on 20-10-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Mulkh Raj Saini an employee of the consumer has appeared and has produced the authority letter dated 20-10-16 which has been placed on record. He has submitted the representation dated 20-10-16 which has been placed on record and a copy of the same has been supplied to Dy. CE/DS Circle, Jalandhar for his comments within 10 days to the committee with a copy to the consumer for his rebuttal, if any, within the next 10 days thereafter. The Committee observed that the consumer is deliberately delaying the case and the payment of the amount raised against him. The consumer’s representative is directed to deposit 20% amount more within 7 days for getting this adjournment and he has given undertaking that he will deposit it. In case the amount is not deposited, the claim shall be treated as chargeable from the consumer and the representative agreed to it. In the interest of justice the case is adjourned finally to the next date and no more adjournment shall be granted under any circumstances what-so-ever. The case is adjourned accordingly to the next date.
3 Tue 22, Nov 2016  This case, again, came up for hearing before the Committee on 22-11-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Mulkh Raj Saini an employee of the consumer appeared in the meeting. He submitted his representation dated 22-11-16 which has been placed on record and a copy of the same has been supplied to Dy. CE/DS Circle, Jalandhar for his comments. The relevant DDL printout(with temper data), MCO and the consumption data from 1/2013 onwards (with dates old & new reading) be supplied to the Committee with a copy to the consumer for submission of his rebuttal, if any, within 7 days. The case is adjourned to the next date.
4 Tue 24, Jan 2017  This case again came up for hearing before the Committee on 24.01.2017. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Mulkh Raj Saini an employee of the consumer appeared in the meeting. He submitted his rebuttal which has been placed on record and a copy of the same has been supplied to Er. Gopal Sharma, Dy. CE/Op for his comments. After study of DDL print-out and other relevant record, the committee observed that another DDL report and analysis of the same from MMTS is required to ascertain the working of CT/PT unit. Letter be sent to Dy CE/ Enforcement Jalandhar for supplying the information within 7 days. The case is adjourned to next date.
