5.  ਫੈਸਲਾ This case again, came up for hearing before the Committee on 24.01.2017. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Daljit Singh Makkar father of the consumer was present in the meeting. The committee observed that normal monthly consumption of the consumer is about 20000-25000 units but in certain months higher consumption has also been recoded, such as 26070 units, 27074 units and 32482 units in 4/2015, 5/2015 and 4/2016 respectively. The present dispute relates to consumption of 38637 units as recorded in 9/2015. The representative of consumer showed daily reading/consumption record being maintained at their level to monitor the consumption. The committee noted that as per reading record maintained by consumer, consumption of about 37000 units has been shown as recorded in one day i.e.26.8.2015, which is not possible as total consumption for the month is 38637 units (disputed consumption). As such, the record maintained by the consumer and shown to the committee, as evidence of jumping of reading of the meter, was found to be unreliable. Further, the accuracy of the meter was also declared OK in ME/lab, as such somewhat higher consumption as recorded in 9/2015 may be due to higher production or due to wrong reading/consumption reported by meter reader in the previous couple of months. The case was discussed in length and full opportunity was given to the consumer to explain the case but committee find no merit for providing any relief to the consumer in the disputed case. Therefore, the Committee unanimously decided that the amount as per bill issued for 9/2015 is recoverable from the consumer.

1 Thu 20, Oct 2016  This case came up for hearing before the Committee on 20-10-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Daljit Singh Makkar father of the consumer was present in person and he is running the factory as Proprietor. He wants time to submit his representation. The case is adjourned to the next date with the direction that he will submit his detailed representation to the Dy.CE/DS Circle, Jalandhar within 10 days from today with a copy to the ZLDSC. The Dy.CE/DS Circle, Jalandhar will give his comments on the representation within 10 days thereafter and sent to the committee with a copy to the consumer who may submit his rebuttal, if any, within 7 days thereafter. Dy.CE/DS Circle, Jalandhar is also directed to get the DDL for the period of 6 months prior to 10/2015 and supply to the Committee. The case is adjourned to the next date in the interest of justice.
2 Tue 22, Nov 2016  This case, again, came up for hearing before the Committee on 22-11-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Daljit Singh Makkar father of the consumer was present in person in the meeting. He had submitted his detailed representation and the comments of Dy. CE/DS Circle, Jalandhar have also been received and are on record. The Dy. CE/DS Circle, Jalanarhar also presented copy of ECR No. 12/1276 dated 12.04.20215 wherein ASE/Enforcement has added that meter installed in the premises of the consumer is not having data storage facility, as such DDL report is not possible. The committee after discussion on the case directed by Dy. CE/DS circle Jalandhar to supply consumption data for the last 3 years along with dates of reading & MDI, for further discussion. The case is adjourned to the next date of hearing.
