5.  ਫੈਸਲਾ This case came again up for hearing before the committee on 13.06.2017. Er. Parwinder Singh, Dy.CE/DS circle Jalandhar presented the case before the committee. Smt Pushpa Devi appeared before the committee in person and explained that the energy bill issued for the period 14.10.2014 to 18.02.2015 for 14437 units amounting to Rs. 106790/- is abnormal and may be due to some defect in the meter. The committee studied the consumption data of the consumer, LCR dated 21.04.2017 and observed that consumption of the consumer (as per reading/ consumption data) from 2/2011 to 5/2017 is very inconsistent. The consumption of 1404 units was recorded from 15.04.2014 to 18.06.2014 and from 18.06.2014 to 14.10.2014 (about 4 months), it is only 360 units. Thereafter for the period 14.10.2014 to 18.02.2015 (slightly more than 2 months) consumption of 14437 units has been recorded, which appears to be on the higher side. Considering the connected load of the consumer of 3 KW(including one split AC of 2.5 KW). The higher consumption may be due to defect in the meter but ME/Lab report of testing of meter is not available to confirm the fact (the meter was returned in routine and was not got tested from M.E lab). On the other hand from the consumption pattern for the period 10.02.2013 to 18.02.2015, it appears that correct consumption was not being reported and accumulation of consumption to some extent is also not ruled out. The meter of the consumer was replaced on 2/2015 (as is evident from reading/ consumption data) and regular consumption is not available up to 1/2016, however proper consumption is available from 14.01.2016 to 14.01.2017, which comes to 6762 units (11065 KWH-4303 KWH) viz bi-monthly consumption of 1127 units. The disputed meter appears to have been installed in March/April-2013. The case was discussed at length and to meet the ends of justice, it was decieded that the account of the consumer be overhauled for the period from March/April-2013 (from date of installation of meter) to 18.02.2015 with average @ 1127 units\' bi-monthly and amount be recovered accordingly. The Committee further directed Dy.CE/Op Jalandhar to investigate the lapses in this case and take appropriate disciplinary action against meter reader (for not reporting correct consumption) and Junior Engineer concerned (for nopt getting the challenged meter tested from ME/Lab).

1 Wed 22, Feb 2017  This case came up for hearing before the Committee on 22.02.2017.Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Smt. Pushpa Devi with ShP.L.Bangal (her husband) appeared before the committee in person. She produced the receipt of the amount ordered to be deposited in this case and photo copy of the same has been put on record. She stated that representation dated 5.8.16/22.11.16 has already been submitted to Dy CE/Op Circle Jalandhar. A copy of the same has been placed on record.
The Dy CE/Op Circle Jalandhar was directed to submit his comments on the representation of consumer, within 7 days. He was further directed to provide detail of bill issued in 2/2015, get the connection checked from AEE/T and submit LCR (containing detail of load, working of the present meter ), date of execution of MCO and updated consumption data from 1/2011 onwards alongwithdates of old/new readings. He was also directed to ascertain the circumstances as to why the meter has not been got tested from M.E. lab in view of the challenge by the consumer. The case was adjourned to next date of hearing.
2 Wed 26, Apr 2017  This case again came up for hearing before the Committee on 26.04.2017. Er. Parwinder Singh, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Smt. Pushpa Devi was present in person. She has not submitted the representation as directed in the last meeting. She was again directed to submit her representation within 7 days to Dy CE/Op Circle Jalandhar who will give his comments on it within the next 7 days with a copy to the consumer for her rebuttal, if any within 7 days thereafter. This is the last opportunity granted to the consumer to submit her representation. Dy. CE/Op Circle Jalandhar was also directed to ensure complete compliance as per minutes of previous ZDSC meeting and submit the remaining information on the next date of hearing.
The case is adjourned in the interest of justice.
