5.  ਫੈਸਲਾ This case, again, presented by Er. H S Bansal, Dy CE/ DS Circle, Jalandhar on 26.04.2019 before the Committee . Dr. Vishal Gandhi appeared before the Committee and submitted a letter written by Asstt. Town Planner, M C Jalandhar bearing No. MTP/905 dated 03.11.2016 in which, it was written that the building of Dr. Vishal Gandhi, 242 C, Adarsh Nagar, Jalandhar was partially allowed to be opened on the request of Dr. Vishal Gandhi dated 12.09.2016. Similarily, SE/DS Circle Jalandhar also presented the comments onthe representation given by Dr. Vishal Gandhi. During the deliberations, it came out that consumer was billed on ‘I’ Code and “N” Code from 8.10.2015 to 05.03.2016 by the concerned office. It was brought out by Dr. Vishal Gandhi that on 17.03.2016, he got his bill corrected at meter reading 6640 and a bill duly corrected for 2481 units was served to him which was also paid. After this bill, 2 bills were again raised on “I” Code and bill raised on 12.05.2016 was raised on ‘O’ Code for 400 units with initial reading of 264 and final reading of 664. The Committee observed that up to bill raised on 06.05.2016, all the readings initial and final were recorded in 4 Digits and only from the bill of 12.05.2016, 3 Digits readings were recorded. The Committee was of the view that these three Digit readings recorded by Meter Reader were not correct and fictitious which continued till the change of meter in 06/2017. When the meter was removed from the consumer’s premises, no reading was displayed on the meter and reading (NV)was recorded on the MCO by J.E. concerned of the office. In contrary to this in the Challan No. 294 dated 2712.2017, the same meter was shown with KWH reading 60522 and KvAH reading 74698. The Committee was of the view that the reading shown on the meter at time of making challan is not correct and meter has gone defective after 06.05.2016 and as such, the reading shown by the Meter at the time of return to M.E. cannot be considered as correct reading. The evidence given by Dr. Vishal Gandhi regarding Sealing of his premises only shows the date of application submitted by Dr. Vishan Gandhi and the date on which the premises was partially opened. It is not possible from the letter of Asstt.Town Planner MC, Jalandhar to came out with the exact period the building of Dr. Vishal gandhi remained sealed by the Corporation. Also keeping in view the comments presented by SE/DS Circle, Jalandhar and deliberations in the Committee, the members were of the view that meter remained defective from 17.03.2016 till the date of actual removal/ change of the meter and as such, the account of the consumer during this period should be over-hauled with the actual consumption recorded during the same period after the change of defective meter on 10.5.17. As per the Data supplied by the Sub Division, the units recorded after the change of defective meter during the same corresponding period i.e. 10.5.17 to 8.5.18 for one year is 16969 units for 12 months. Payments deposited by the consumer from 2.4.16 to 16.5.17 will be adjusted in the Bills. The refund, if any, should be given through bills including Surcharge levied on the un-paid amount.

Er. Suversha, Sr Xen/Tech. DS Circle, Jalandhar presented the case before the Committee. Going through to consumption data provided by Dy. CE/DS Cirlce, Jalandhar, committee is of the view the data be again checked and true picture from 7.10.14 upto 10.5.17 along with amount paid by consumer be provided for taking further decision in this case. The case is deferred accordingly.
